Ourstix
Terms of Use
Last updated: [effective date]
Draft, under legal review. This page is being reviewed and will change before Ourstix runs its first campaign. Text in [square brackets] is still to be confirmed.
Who we are
Ourstix is operated by [Company legal name], [Mailing address]. Email: hello@ourstix.ca. Phone: [phone number]. These terms apply when you use our website, sign in, give consent, buy from an album's store or run a campaign with us.
Your account
You sign in with your email and a one-time code. Use your own email and your real name: the people who run the album see the name of whoever gives consent. Keep access to your email private.
Consent and buying are separate
A person appears in the album only after they, or their parent or guardian for a child, sign in and give consent through a link of that album. Buying is never required to appear, and a person with consent appears whether or not anyone buys. How we handle personal information is explained in our Privacy Policy.
Photos and stickers
- Add only a photo you have the right to use, of the person you gave consent for, and accept the declaration shown when you add it. The school may add a photo only for a person who already gave consent.
- We crop and place the photo; we do not change the face. Nothing is printed until you approve the finished sticker.
- Once the album list is final, sticker numbers do not change.
Pre-order
- Before an album's prices are set, you can reserve what you want. A reservation charges nothing and does not oblige you to buy; you can change or cancel it until the pre-order closes.
- During pre-order we show a price range. The price is set from the real number of albums, and we email you when it is published.
Orders
- Prices are in Canadian dollars and are shown before you pay. A price change applies only to new orders. HST is added at checkout [tax treatment to be confirmed with an accountant].
- To buy, you sign in as someone in the album, or through a purchase link someone in the album gave you.
- Payment is made on Stripe's secure checkout page. Your order is confirmed when the payment is confirmed, and we email you a receipt with a link to your order.
- Sticker packs contain stickers chosen at random. Duplicates are part of the game: they are for swapping.
- In the last month of sales you can order missing stickers by number. They are made for you.
- Each store is open only during the dates set for the album. Everything paid is printed.
Purchase links
Someone in the album can make a link for relatives and friends to buy for them. The link works for two weeks and shows only products and prices. Share it only with people you trust; you can withdraw it at any time. What is bought through it is delivered with your order, in your child's bag.
Delivery
Paid orders are printed in batches, every two weeks, and delivered to the group: to your child's class, team or room, in a bag with the child's first name, or, where only adults appear (a college, a workplace, an event), to the organization, in a bag with your first name [timing: for example, within X weeks after the batch closes]. We email you when your order is delivered. There is no home delivery yet. [Responsibility once the order is handed to the organization.]
The swap area
The swap area is optional. It shows you who in the album can swap with you: their first name, class and the numbers. There are no messages between people; swaps happen in person, following your school's rules. Use what you see only to swap stickers.
Cancellations, refunds and missing items
Use "Need help with this order?" on your order page, signed in with the email you paid with, or write to support@ourstix.ca with your order link.
- Until your order goes to print (orders are printed in batches, every two weeks), you can cancel it on your order page and get everything back, tax included.
- Once it is printed it cannot be cancelled. If something is missing or damaged, we send it again, free, with the next print batch, to the same place. When that is not possible, we refund those items, tax included.
- Stickers chosen by number ("Complete my album") are made for you: they are replaced, not refunded.
- Refunds go back to the card used. Your bank usually shows them within 5 to 10 business days.
For schools
- The campaign, its dates and the school's share are set in an agreement with the school [campaign agreement].
- The school receives the agreed share of net sales: sales without taxes and without refunds. It is paid for the orders of each print batch once the batch is delivered, [method, for example by Interac e-Transfer, within X days]. Our standard share is 25%. A refund made after a payout is taken off the next one; the school is never asked to pay anything back.
- The school chooses what the money funds and can change it until the campaign closes.
- The people who run the album see counts and their own class, never who declined or what a family bought, and use what they see only for the album.
- Questions about a campaign: schools@ourstix.ca.
Links
Class links, purchase links and order links are meant for the people they were given to. Do not post them publicly. Consent, photos and orders always need you to be signed in.
Acceptable use
Do not try to access information that is not yours, guess links, overload the website or use it for anything unlawful. We limit repeated attempts and may block access that breaks these terms.
Album content
The album design, illustrations and website belong to [Company legal name]. Photos remain the property of their owners; we use them only to make and print the album, and delete them 60 days after sales close. [Decide: ask families not to post album pages showing other children online.]
Limits of our responsibility
[To be written with counsel: limitation of liability that respects Ontario consumer protection law.]
Law that applies
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
Changes
If we change these terms, we will update the date above. Changes do not apply to orders already paid.
